MINUTES <br />CITY COUNCIL <br />DECEMBER 27, 2012 <br />mentioned the addition of $100,000 of landscaping money as <br />noted in Item G. <br />I. Provide Little Canada three percent (3 %) enhancement money <br />based on the costs of sound barriers constructed in our <br />community as part of this project. Little Canada to work with <br />on the specific enhancements to be implemented. <br />MN DOT has indicated acceptance of this condition. <br />J. MN DOT is to evaluate additional sound reduction on the <br />Unweave the Weave fly -over bridge by possible use of <br />construction barriers on north side of bridge as well as review <br />the sound source study that impacts the Twin Lake <br />neighborhood given other potential sound sources from the <br />freeway. <br />Norris reported that MN DOT is looking into this. <br />DONOVAN Given Jim Tolaas' unavailability at this time, the Council reviewed <br />PROPERTY the proposed purchase agreement for the Donovan Construction <br />& CELL property as well as for the purchase of the cell tower lease on the <br />TOWER property. The City Administrator reported that the City Attorney <br />LEASE has reviewed the draft purchase agreement and has modified the <br />PURCHASE language relative to the environmental section of the agreement. <br />AGREEMENT The Administrator reported that the purchase price for the land is <br />$408,500 and the purchase price for the lease is $250,000. The <br />Administrator indicated that Donovan Construction would like to <br />have a signed purchase agreement before the end of the year. The <br />closing would likely take place in January upon completion of <br />environmental and title work. Once the closing occurs, Donovan <br />Construction would have another 30 days to occupy the property. <br />Montour asked the funding source for this purchase. The <br />Administrator recommended that approximately $330,000 to <br />$350,000 come from the City's economic development monies and <br />the balance from an interfund loan from Water & Sewer Capital <br />Reserve funds. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -12 -226 — APPROVING THE <br />PURCHASE AGREEMENT FOR THE DONOVAN <br />CONSTRUCTION PROPERTY ($408,500) AS WELL AS CELL <br />TOWER LEASE ($250,000) AT A TOTAL PURCHASE PRICE <br />5 <br />
