MINUTES <br />PLANNING COMMISSION <br />APRIL 10, 2008 <br />property taxes each year for which he obtains no City services. Deeb stated <br />that he has been promised a road and does not have it. He also reported the <br />vandalism problem in his area and indicated that semi-trailer storage has <br />worked to help curtail theft losses. Deeb expressed concern with the lack of <br />police protection in his particular area. <br />The City Administrator indicated that he would have to research the history <br />of the uses on the Deeb property to determine if any of those uses would be <br />grandfathered in. If they are, then the amended ordinance would not apply <br />to his property until such time as he requests a change. If they are not <br />grandfathered in, Mr. Deeb would be subject to the conditions outlined in <br />the ordinance. <br />The City Administrator noted that as the result of extensive code <br />enforcement issues on properties such as Valor Enterprises, the City <br />undertook the study of the I-1 Dishict. The Administrator noted that many <br />properties have CUP's and some property owners have done a good job <br />complying with the conditions of their CUP's. Others have not. The <br />Administrator also noted that the existing I-I standards are more lax than <br />exist in other communities. He also pointed out that the code enforcement <br />issues have had a negative impact on property values. The Administrator <br />pointed out that those property owners doing a good job with their <br />properties should not be penalized by those that do not. The Administrator <br />stated that with regard to Mr. Deeb's comments about the lack of police <br />protection, he would discuss this issue with the Sheriffls Department. <br />The Administrator noted that code enforcement has been somewhat of a <br />cyclical issue for the City, and he listed some of the major problem <br />properties that the City has dealt with. The Administrator pointed out that <br />the Council had initially contemplated much more restrictive conditions <br />such as allowing outdoor storage by Interim Use Permit rather than CUP. <br />The Administrator noted that in discussions with the Ryan Industrial Park <br />property owners at recent workshop meetings, the Council agreed to <br />continue outdoor storage as a CUP. He also noted that at those workshop <br />meetings, the Ryan Industrial Park property owners asked for more code <br />enforcement. With regard to Mr. Deeb's comments, the Administrator <br />indicated that staff will have to review his property file to determine <br />whether or not his containerized storage is grandfathered in. <br />Stanke indicated that when he advertises space for rent, most of the <br />inquiries are for a loading dock. Stanke noted that none of the buildings in <br />Ryan have loading docks, therefore, but use trailers for storage given the <br />ability to back up to a trailer at the same level and load and unload. <br />Deeb noted that D & T Trucking has 30 trailers. There are four on his <br />property and two on the Donovan property. Deeb noted that these trailers <br />-5- <br />
