EXHIBIT A Minnesota Department of Transportation Metropolitan District Waters Edge - Program Delivery 1500 West County Road 8 -2 Roseville, MN 55113 -3174 February 12, 2013 Mayor Bill Blesener City of Little Canada 515 Little Canada Road East Little Canada, MN 55117 Telephone: 651- 234 -7724 Fax: 651 - 234 -7709 RE: MnPASS - Revised Draft - Potential Conditions of Approval dated November 28, 2012 Dear Mayor Blesener: I am writing to respond to the conditions of approval documented in the Memorandum dated November 28, 2012 from Joel Hanson to you and the councilmembers for the upcoming 35E MnPASS project. Before starting, I want to emphasize our continued good faith efforts that have resolved many of the items listed in the Memorandum. I see many positive benefits coming out of our discussions so far. I will list your item with MnDOT's response directly below each. Item 1: Remove brush from fence and established plantings on I -35E right -of -way along Country Drive from Water Works area to Little Canada Road. Response: MnDOT is prepared to remove brush from selected locations identified in a future field walk of the area with Metro's Attractive Roadsides Superintendent, DeWayne Jones. He has committed to placing the work on this upcoming season's work schedule. Item 2: In coordination with the City and work on MnDot's storm sewer pipes transversing under Country Drive and 1-35, address necessary repairs to the City's 15" storm sewer inlet on Country Drive to eliminate the cause of the sinkhole in this area. Response: MnDOT, as part of the drainage work on the storm water conveyances under I -35E and Country Drive, will investigate the existing condition of the City -owned 15" storm sewer inlet and make recommendations, if needed, for any repairs. The City will be responsible for the costs associated with any City- requested repairs. Item 3: Reimburse the City for its cost to upgrade the Little Canada Road Bridge in 2010. (Reimbursement to the City may be by direct payment or some other improvement that results in a dollar offset equal to or greater than the amount indicated below. Background: MnDot claimed this bridge was not in the Unweave the Weave project area and required the City to enter into a Cooperative Agreement (No. 95132 - S.P. 6280-357) to have the outdated fencing removed from the concrete sidewalls and to paint the bridge & abutments. Given all of the work that has been done in this corridor and paid for by MnDot, it isn't fair to the residents of Little Canada that they had to fund 50% of the costs for basic bridge improvements that should have been part of the project.
