N <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: March 11, 1997 <br />RE: Little Canada - Knox Garden Center CUP <br />FILE NO: 758.09 - 97.04 <br />Knox Lumber is requesting a Conditional Use Permit to allow placement of a seasonal <br />temporary garden store enclosure and a permanent steel tubing structure on which shade - <br />cloth fabric would be hung during the season. These structures are to be located within <br />the current garden area between the principal Knox Lumber sales building and Country <br />Drive. Issues raised by this request are listed below: <br />Setbacks. The front yard setback adjacent to County Drive applies to all <br />commercial activities. According to the site plan, it would appear that the leading <br />corners of both the steel tube structure and an existing building in the garden area <br />violate the 40 foot front yard setback requirement. The new plant -house enclosure <br />is proposed to be located behind the setback line. We are not aware of any front <br />yard setback variances approved to prior building or remodeling proposals on the <br />Knox property. Nor is there any apparent hardship which justify the consideration <br />of a front yard setback variance. Therefore, we are recommending the all garden <br />center area structures be located in such a way as to comply with the 40 foot <br />setback from Country Drive, including modification or relocation of the existing <br />garden center building. <br />Parking. The location of the proposed improvements will not interfere with any <br />circulation or parking on the Knox property.
