Due to the <br />depth of the lot, it is unlikely that the proposed building will be used as a garage. <br />Conditional Use Permit. The addition of the proposed 600 sq. ft. detached building to <br />the 624 sq. ft. attached garage would bring the total accessory building area on the subject <br />site to 1,224 sq. ft. Section 903.020.D.4 of the Zoning Ordinance allows for accessory <br />building area in excess of 1,000 sq. ft., but not more than 1,500 sq. ft. by CUP. <br />The Planning Commission and City Council shall consider possible adverse affects of the <br />proposed conditional uses. The judgement of the Planning Commission and City Council <br />shall be based upon (but not limited to) the following factors: <br />1. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed conditional use has been considered in relation to the specific policies <br />and provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future and uses of the area. <br />3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained in the Zoning <br />Ordinance. <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed conditional use will not tend to or actually depreciate the aggregate <br />property values in the area in which the conditional use is proposed. <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roofline; <br />b. Architectural style; and <br />c. Exterior finish materials. <br />The subject site is an over sized lot, approximately 40,000 sq. ft. in area. Due to the size <br />of the proposed lot, we do not believe that the proposed accessory structure would present <br />any negative impacts to adjacent properties, provided that it is used for storage of <br />Page 6 <br />
