MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 11, 1997 <br />CUP TO ALLOW <br />EXPANSION <br />OF NON- <br />CONFORMING <br />USE — <br />34 E. OWASSO <br />BLVD. <br />LUNZER <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Carson recommended approval of the division of 45 W. Demont Avenue <br />into two single - family lots subject to compliance with the <br />recommendations of the City Planner as outlined in his report dated <br />September 9, 1997. <br />Motion seconded by Keis. <br />Motion carried 5 — 0. <br />Mr. Tom Buroker and Ms. Alicia Lunzer appeared before the Commission <br />requesting approval of a Conditional Use Permit to allow the expansion of <br />a non - conforming single - family house located at 34 E. Owasso Blvd. Ms. <br />Lunzer reported that they would like to put a small addition onto the first <br />floor of the house and then add a second floor to the home. Lunzer noted <br />that the Planner's report refers to the house being surrounded by Industrial <br />development. Lunzer pointed out, however, that there are a lot of houses <br />located just a block from this one. <br />Keis asked how long the property has been zoned Industrial Park. <br />The City Planner pointed out that the Yorkton Industrial Park has been in <br />existence for the past 15 to 20 years. The north side of South Owasso <br />Blvd. was rezoned to I -P in 1990 or 1991, and prior to that had been zoned <br />Light Industrial. <br />Keis pointed out to the applicant that by allowing the non - conforming use <br />to expand, it becomes more expensive to convert the property to an I -P <br />use. Keis felt there was also the issue of raising a family in an industrial <br />area. <br />Lunzer pointed out there is a mobilehome park just two blocks away and <br />that there are many families in the area. Lunzer indicated that they felt <br />safer raising their family in Little Canada than in another part of the metro <br />area. <br />In response to a question from Keis, the Planner clarified that the Code <br />would allow the house to be rebuilt only if it was more than 50% <br />destroyed as the result of a fire or other catastrophe. The Code does not <br />prohibit an improvement to the property more than 50% of the present <br />value. The 50% rule comes into play only for structures that have been <br />damaged or destroyed. <br />Page 9 <br />
