Mayor & City Council <br />November 21, 1997 <br />Page 2 <br />Some other information I feel you should have relative to this matter is: <br />♦ We attempted on numerous occasions to negotiate a voluntary arrangement to minimize <br />costs and avoid any Court proceedings. We were told no one objected to razing the <br />house and our agreement was recommended for approval by one of the attorneys <br />involved. <br />♦ In the spring of 1992, we went to Court and obtained an order to raze the structure. <br />Quotations were received for this work and we were prepared to proceed until the matter <br />was appealed and a new Court order was issued. <br />♦ Their attorney was notified of the prospective bidders and the specifications prior to the <br />work taking place. (See copy of letter from Sweeney, Borer & Ostrow dated October 14, <br />1992.) No objections to our process were received at that time. <br />♦ The City has $10,496.78 into this project including the $5,300 for demolition and $700 <br />paid to the Klein's attorney pursuant to Court order. We are only attempting to recover <br />the cost of the demolition. <br />♦ The building was destroyed by fire on June 19, 1991. Clean-up did not occur until <br />November of 1992. <br />I will be prepared to speak to this issue as needed at Wednesday's meeting.
