MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 2013 <br />given the building pad location on Lot 11, the pines to the north cannot be <br />saved without eliminating this lot. The majority of trees along Lot 12 will <br />be able to be saved. Again, the Engineer noted that the purchase <br />agreement addresses trees within the 33 -foot road easement, and that the <br />trees are actually outside of this easement. <br />The Engineer then discussed the potential to develop the back portion of <br />2925 LaBore Road given that this lot abuts the existing 33 -foot street <br />easement which is proposed to be vacated. The Engineer presented a <br />sketch plan which shows improvement of a short cul -de -sac street on the <br />road easement plus an additional 17 feet from 2925 LaBore Road (total 50 <br />foot right -of -way as required by Code). The Engineer pointed out that it <br />would be possible to subdivide an 11,500 square foot lot from 2925 <br />LaBore Road, but noted that the building pad would be narrow and the <br />setback for the existing house would not meet setback minimums as it <br />would become a corner lot. The Engineer also noted that the cost of the <br />street and utilities would likely negate any profit from the sale of the <br />additional lot. <br />The Engineer then presented a diagram which would incorporate a portion <br />of 2925 LaBore Road (6,300 to 6,400 square feet) into the Pinetree Pond <br />development which would result in an additional lot within that <br />development, and provide the owners of 2925 LaBore Road some <br />development potential. The property owners have not made a decision on <br />that option. <br />The City Administrator reported that the owners of 2925 LaBore Road <br />could not be present this evening, and have presented a letter outlining <br />their concerns for the loss of privacy and screening pointing out that four <br />of the proposed lots would back onto their property. These property <br />owners have requested that trees be preserved as agreed to in the sales <br />contract between Masterpiece Homes and the previous owners of 2945 <br />LaBore Road as well as the addition of plantings of coniferous trees to <br />replace those lost and screen their property. The City Administrator <br />reported that there are been discussions with these property owners <br />relative to the addition of trees for screening on their property, and they <br />appeared to be accepting of that option. The Administrator reported that <br />the property owners will get back to the City on both the issue of plantings <br />on their property and the development of the back of their property as <br />discussed by the City Engineer. <br />The City Administrator next reviewed the future development of the <br />northeast properties and three potential options, i.e. the option presented <br />by the Brausen family, the option utilizing the existing 33 -foot street <br />easement, and the ghost plat with the purchase of the back portion of the <br />4 <br />
