Setbacks: As demonstrated below, the existing structures on Lot 1 meet all of the City's <br />minimum setback requirements. Please note within the requirements below, that the <br />principal building was constructed prior to June 25, 1980, therefore, the required side yard <br />setback is five (5) feet. There are no structures proposed on Lot 2, at this time, however, <br />any new structure must conform to the minimum required setbacks as shown in the table <br />below. <br />** <br />Required Setbacks within the R -1 District <br />Required Principal Bldg. Garage <br />Front (street) 30' 30' 35' <br />Rear 30' 100' 105' <br />Side* 5' 5' 50 +' <br />Side ** 10' 50' 10' <br />Any parcel of land upon which a single family residence was constructed prior to June 25, <br />1980 shall maintain a minimum five (5) foot interior side yard setback fro the principal <br />building, future attached additions to such building, and from any existing or newly created <br />lot lines. Legally non - conforming accessory buildings constructed on single family parcels <br />prior to June 25, 1980 shall be allowed to be rebuilt at their prior side yard setback distance, <br />provided such setback is at least five (5) feet. <br />Accessory buildings shall in all other cases maintain a minimum interior side yard setback <br />of ten (10) feet. <br />Easements: Per Section 1006.040 of the City's Subdivision Ordinance, easements for <br />utilities at least six (6) feet wide shall be provided along all lot lines, unless the required <br />easements are waived by the City Council after receipt of a written recommendation of the <br />City Engineer. The proposed lot split does not indicate any easements along the lot lines. <br />Therefore, this item is subject to review and approval of the City Engineer, in regard to <br />establishing easements along lot lines. <br />Park Dedication: Subdividers, as a prerequisite to approval of a subdivision, shall <br />dedicate to the City or dedicate to the public use, for park or playground purposes, land, <br />or the cash equivalent of land. The form of contribution, cash or land, is subject to <br />recommendation of the Little Canada Parks and Recreation Commission, and approval by <br />the City Council. <br />RECOMMENDATION <br />The proposed subdivision of Mr. Becker's property into two separate parcels is in <br />conformance with the City Code, therefore, our office recommends approval of the <br />subdivision subject to the following conditions: <br />2 <br />Page 76 <br />
