WHEREAS, Grantee's application for funding its 1995 Minnesota ReLeaf Project <br />(hereinafter referred to as the Project Proposal) has been approved by Grantor in the amount of <br />$ 10,000.00 ; and, <br />WHEREAS, Grantee has agreed to provide a local cash or in -kind contribution of at least <br />50% of the Project Proposal; and, <br />WHEREAS, Grantee has agreed to carry-out a specified 10 -year maintenance plan. <br />NOW THEREFORE, the parties hereto agree as follows: <br />A. Grantor shall grant Grantee the sum of $ 10,000.00 to be used to complete the <br />work as outlined by (1) the Grantee's Project Proposal, and (2) the Minnesota <br />ReLeaf Cost Share Practices as distributed in the Minnesota ReLeaf Planting for <br />Energy Conservation Program Application Package 1995. This Project Proposal <br />shall become a part of this Agreement. Any changes in the work must be <br />submitted in writing and approved by Grantor prior to the work proceeding. <br />B. Grantee acknowledges that these funds are proceeds from oil overcharge money <br />(hereinafter the "Fund ") and are subject to certain legal restrictions and <br />requirements including Minnesota Statutes Chapter 116P. The State has received <br />these funds as part of a judgment in a lawsuit brought by the US Department of <br />Energy against various parties for petroleum pricing violations. The funds were <br />distributed to the State and their uses are specified by the settlement agreement <br />identified as M.D.L. Number 378. These monies are subject to federal statutes <br />and regulations issued by the US Department of Energy settlements and Minnesota <br />Statutes Section 4.071, subd. 2. The Grantee is responsible for compliance with <br />these and all other applicable state and federal laws and regulations promulgated <br />pursuant thereto governing the proceeds of the oil overcharge money in the <br />fulfillment of the project. <br />C. Grantee shall be responsible for the planning, supervision, and satisfactory <br />completion of work specified in the Grantee's approved Project Proposal and for <br />payment of all monies for work undertaken in accordance with the project. <br />D. Reports and Records: <br />1. Expenditure and Final Project Report <br />Grantee shall furnish Grantor with a Final Project Report upon completion <br />of the project, but no later than May 31, 1997 on a form provided by the <br />Grantor. It shall contain appropriate certification that all completed work <br />conforms with the specifications contained in the Grantee's Project <br />Proposal or as amended in writing.
