compliance prior to issuance of a permit to any contractor
<br />performing work within the jurisdictional limits of City.
<br />5. City shall be solely responsibility for direct payment of
<br />any fees or charges to the Metropolitan Waste Control Commission,
<br />State of Minnesota or any of its subdivisions, and Ramsey County as
<br />may be required by law affecting development and issuance of
<br />building permits within its borders.
<br />6. City, its officers, agents, and employees shall cooperate
<br />with and assist Building Official in the orderly performance of
<br />services to be provided for herein.
<br />7. All applications for building permits and building
<br />inspection forms to be utilized hereunder shall be provided by City.
<br />8. City, its officers, agents, and employees do not assume
<br />liability for any negligent or intentional acts of Building Official
<br />or any of its officers, agents, or employees and Building Official
<br />shall indemnify and defend City, its officers, agents, and employees
<br />against and hold City, its officers, agents, and employees harmless
<br />from any claims, causes of action, damages, loss, cost, or expense
<br />resulting from or related to the actions of Building Official, its
<br />officers, agents, or employees in the performance of this Agreement.
<br />9. Building Official, its officers, agents, and employees do
<br />not assume liability for any negligent or intentional acts of City
<br />or any of its officers, agents, or employees. City shall indemnify
<br />and defend Building Official, its officers, agents, or employees
<br />against and hold Building Official, its officers, agents, and
<br />employees harmless from any claims, causes of action, damages, loss,
<br />cost or expense resulting from or related to the actions of City,
<br />its officers, agents, or employees in the performance of this
<br />Agreement.
<br />10. It is understood that enforcement and administration of
<br />the Minnesota State Building Code is a public service and is of
<br />necessity limited in nature. Consequently, building permits and the
<br />subsequent building inspections are not to be construed or relied
<br />upon as any type of warranty, guarantee, or representation on the
<br />part of Building Official that the plans, construction, or finished
<br />product are necessarily in conformance with the provisions of the
<br />Minnesota State Building Code or other application construction
<br />standards.
<br />11. It is understood that this Agreement contains the entire
<br />agreement between City and Building Official and that no statement,
<br />promise, or inducements have been made to any party hereto, or any
<br />officer, agent or employee of either party hereto which is not
<br />contained within this written Agreement. This Agreement may not be
<br />enlarged, modified, or altered except in writing signed by the
<br />parties and endorsed herein. It is expressly understood between the
