City Council <br />April 24, 1935 <br />ZLetluw <br />Variance <br />(Cont.) <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (5) ?lardini, Scalze, Blesener, Collova, Fahey. <br />Mayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 12, Page 193. <br />Text Mayor Fahey opened the public hearing on a proposed text amendment <br />Amendment defining community centers and neighborhood centers. <br />Community <br />& Neighborhood It was noted that the Planning Commission denied the proposed definition. <br />Centers Mrs. Scalze aLso pointed out that the Planning Commission did not get <br />all the information until after their meeting. <br />Agenda <br />Item No. 9 <br />Mr. Paul Borg of 2370 Jackson Street and Assistant Superintendent for <br />the Roseville School District appeared before the Council. 9r. 3org <br />stated that he felt the definitions were a result of the action of <br />the School Board with regard to Xellogg High School. Mr. Borg pointed <br />out that the fate of Kellogg remains to be seen. <br />Mr. Borg stated that he felt the language in the definition was <br />redundant. Borg felt that Section 920.020 already covers the situation. <br />Mr. Borg pointed out that under the proposed definition even congregate <br />dining would not be allowed. <br />Borg also pointed out that even the City Center would not be in <br />compliance with the zoning. <br />Borg also pointed out that Minnesota Statutes 123.35 Subdivision 10 A :4 C <br />says that a School Board may lease a school house to any person or <br />organization. Borg felt that the statute implied that a School Board <br />has some rights as to the uses of school houses. <br />Mr. Borg requested that the City not enact the proposed definitions. <br />Mrs. Scalze pointed out that the Statute did not say that the School <br />District could act outside the zoning code. <br />`r. Borg informed the Council that when the School District planned for <br />Fairview Junior High's use, it developed a close wor'cing relationship <br />with the City of Roseville. The School District did not chose to <br />ignore the City's zoning. The City cooperated and the School District <br />cooperated. The School District has made the building available to <br />many organizations including senior citizen congregate dining. <br />Mrs. Scalze asked the different uses at Fairview. :!r. Bob Beirshied, <br />Assistant Director of Community Education, appeared before the Council. <br />Biershied stated that the majority of uses are community use space. <br />Page 2 <br />
