Page 2 <br />May 1, 1985 <br />Mr. Walbon discussed the building permit with Joseph G. Chlebeck <br />who indicated that permits would have to be delayed until at <br />least May 8, 1985. We are now led to believe that there will be <br />an open hearing on May 8, 1985, and perhaps the moritorium will <br />be lifted by May 22. <br />To complete construction by the date on which the St. Anthony <br />property must be vacated, it is crucial that the Walbons receive <br />a building permit by May 22. I am suggesting to Mr. Walbon that <br />he attend your council meeting on May 8 and speak to any concerns <br />that you may have concerning their business and usage of the <br />proposed building and land. <br />We believe that an appropriate interpretation of the Minnesota <br />law would allow the District Court of Ramsey County to issue a <br />Writ of Mandamus requiring the City to issue a building permit to <br />Mr. Walbon.
