The
Planner replied that he could, but Mr. Fritz would be charged for it.
Mr. DeLonais did not feel that the matter could be resolved until the
moratorium is lifted. Mr. Fritz stated that the City Attorney told
him that the moratorium did not apply in this case.
The Planner stated that the Attorney did not indicate this to him.
Mr. Davison stated that he would like to see something on the drainage
for this property.
Mr. Herkenhoff recommended that the Budget Auto conditional use permit
be tabled until the City gets a scaled plan.
Motion seconded by Mr. Costa.
Motion carried 5 — 0.
Mr. Larry Lee submitted to the Commission a plan for the development
of property along South Owasso. The plan calls for 16 residential
lots on the south that would consist of single family lots on the
south and duplex lots on the north. Mr. Lee indicated that Mr.
Fahey has stated that he would not be in favor of duplex lots.
Mr. Lee pointed out that his plan provided for a 50 foot buffer
zone between the industrial and single family.
Lee then explained the grades of the property, along with the drainage.
Mr. Lee reported that Mr. Fasciana is concerned about how he
will service his lois. Lee stated that he would be willing to
exclude one of the lots in his plan for future access to the Fasciana
property. However, Mr. Lee did not know what Mr. Fasciana's feelings
would be about this.
Page —4—
