MINUTES <br />Planning Commission <br />August 8, 1985 <br />Boss Boss commented that the issue of the house would be discussed at the <br />Subdivision public hearing and reported that he is requesting concept approval <br />(Cont.) tonight. <br />Vitale Fence <br />Grittman stated that the location of the house inhibits the ability to <br />divide the property. Grittman again pointed out that the ordinance <br />requires the non- conformity to be lessened. Grittman also stated that <br />the location of the house will be an incumbrence on the title of the <br />property. <br />Mr. Boss reported that his plans were to leave the house and rent it out <br />for four or five years. Then his son will eventually build on the <br />property and the house will be torn down. <br />Timmons pointed out that a portion of the house is on the alleyway. <br />Timmons asked why the vacation was not being pursued. Mr. Boss reported <br />that there have been some negative reactions from the adjacent property <br />owners on the vacation. Boss stated that he did not want to complicate <br />the matter and, therefore, withdrew this portion of his request. <br />Mr. Gene Fasciana stated that he was the adjacent property owner and the <br />reason that he was opposed to the vacation was that he had commercial <br />property and he would have to maintain certain setbacks to residential <br />property. Therefore, it would be to his advantage to keep the alleyway. <br />Mrs. Timmons stated that she would like a legal opinion on the question <br />of the house. DeLonais suggested that the matter be tabled until <br />the Commission gets more information. <br />Timmons pointed out that Boss's request still consists of four lots and, <br />therefore, would be subject to platting. <br />Boss requested that the Commission give him concept approval based on <br />his replatting the property. <br />Mrs. Timmons recommended concept approval of the Boss Subdivision of <br />five lots contingent upon the replatting of the property and the issue <br />of the house being resolved. <br />Motion seconded by Mr. Ducharme. <br />Motion carried 7 - 0. <br />Mr. Joseph Vitale appeared before the Commission requesting a variance <br />to construct an 8 foot fence around his pool. Vitale reported that the <br />pool is located along County Road C and that there is a slope in the <br />road at that point that would cause headlights to reflect into the pool <br />area with a 6 foot fence. <br />Vitale reported that the pool is located about 10 to 15 feet from the <br />existing fence that runs along County Road C. <br />Page -6- <br />
