MINUTES <br />Planning Commission <br />August 8, 1985 <br />Steneroden <br />Proposal <br />(Cont.) <br />Boss <br />Subdivision <br />Mr. Costa informed the Iona Lane residents that something will develop <br />on this property eventually. DeLonais stated that he feels the proposal <br />would have been passed if the B -3 zoning had not extended behind Lot 15. <br />Dick Boss III appeared before the Commission requesting approval of the <br />subdivision of his property. Boss reported that originally he was also <br />requesting vacation of an alleyway, but has eliminated this from his <br />request. Boss is requesting that his property be divided into five <br />buildable lots. <br />Boss commented that the ordinance requires platting for four lots or <br />more. However, it was Boss's contention that his property has already <br />been platted, and he is asking for an adjustment of lot lines. The <br />resulting lots would be described by metes and bounds survey. Boss <br />pointed out that platting would cost him an additional $1,500 to $1,800. <br />Mr. DeLonais reported that platting is required of everyone with four <br />or more lots. <br />Timmons stated that there is nothing the Commission can do about this <br />as it is required by ordinance. <br />Costa pointed out that there is also a problem with the location of the <br />existing house on the property. <br />Timmons felt that the City could not approve Boss's request until <br />the house was brought into conformance or removed. <br />Mr. Grittman stated that the house is presently non - conforming under the <br />ordinance and the ordinance does not allow a non - conformity to be <br />increased. Grittman stated that to approve Mr. Boss's request, the <br />non - conformity would have to be lessened. <br />Mr. Boss then reduced his request to subdivide the property into three <br />buildable lots. <br />Timmons asked if this was a way of getting around the ordinance. Mr. Boss <br />replied that he planned to sell two lots right away, but would not sell <br />any other lots for four or five years. <br />Mrs. Timmons pointed out that the ordinance might change in four or five <br />years and it might be to Mr. Boss's benefit to plat the property now. <br />Boss stated that this is a gamble that he would have to take. <br />Mr. Davison asked how the house would be accessed. Mr. Boss replied that <br />there is currently a long driveway accessing the house. <br />Grittman again pointed out that the house straddles lot lines. Boss <br />stated that he can keep the house due to adverse possession. Grittman <br />explained adverse possession. <br />Page -5- <br />
