' MINUTES <br />City Council <br />June 12, 1 °S5 <br />Frattalone <br />Property <br />(Cont.) <br />Scalze pointed out that minor auto repair is allowed, but major is <br />not. Scalze commented that this situation would have come up when <br />the City got its licensing requirements done. <br />Fahey pointed out that in July of 1974 the City issued a special use <br />permit to Frattalone Excavating. Now this business is located in <br />the industrial park. Fahey also commented that the residents of the <br />area complained in November of 1982 and the City did not follow -up <br />on the situation at that time. <br />Mr. Frattalone suggested that he meet with the Planner and see what <br />can be worked out. <br />Mr. Frattalone also commented that he is renting to Auto Elegence <br />and they are only doing clean -up. Scalze stated that she went by <br />the property and they were doing painting. <br />Mr. Mark Schultz, a resident of the area, pointed out the overhead <br />tanks and the fact that the State Fire Marshall and City Fire <br />Marshall have indicated that these are in violation of City Code <br />and must be removed. <br />Mr. Fahey commented that Rudy Excavating received this notice. <br />Frattalone agreed that he was not aware of this. <br />Frattalone requested that he be given 30 days to clean up the area. <br />Fahey indicated that the matter will be discussed at the first meeting <br />in July and in the meantime Mr. Frattalone should meet with the <br />Planner. Fahey also requested that the Planner make some recommendations <br />on the situation. <br />Mrs. Scalze pointed out that the west side of Park Street is B -3 and <br />asked Frattalone's feelings for rezoning the property to R -2. <br />Frattalone pointed out that the west side of the street was assessed <br />at a higher rate than the residential side. <br />Frattalone Mr. Frattalone reported that he brought water to his shop from County <br />Assessments Road C. At the time that the City brought water into the area, he <br />was assessed $6,000. Frattalone reported that he had an agreement <br />Agenda with Clayton Parks that he would not be assessed when the City <br />Addition brought water in. <br />Mr. Fahey stated that if this situation was discussed on the record, <br />the Council will honor it. <br />Nardini felt that the matter should have been brought up at the time <br />of the assessment hearing. <br />Scalze asked if Frattalone already has water, why would the City assess <br />Page -8-7 , <br />21 <br />
