MINUTES <br />Planning Commission <br />May 8, 1986 <br />Borg Mrs. Timmons recommended that the Borg property division request <br />Property be sent to the Council with no recommendation by the Planning <br />Division Commission and requested that the Planner prepare a report on <br />(Cont.) the request to be sent directly to the Council and further <br />indicated that the Planning Commission sees no need to review <br />this request again. <br />Louis <br />Tima <br />Property <br />Division <br />Motion seconded by Mrs. Schweizer. <br />Motion carried 6 - 0. <br />Mr. Louis Tima appeared before the Commission requesting the division <br />of his property located on County Road C. <br />The Planner reported that there is 33 feet dedicated for Jackson <br />Street between Bluwood and Australian and he is recommending that <br />an additional 17 feet be dedicated in order for there to be legal <br />access to the property Mr. Tima would like to divide off. The City <br />ordinance requires 50 feet right -of -way for residential streets. <br />Mr. Tima stated that he could live with dedicating an additional <br />7 feet so that the street would have a 40 foot right -of -way. Tima <br />also pointed out that Australian has only 40 feet of right -of -way. <br />Costa pointed out that Jackson Street would only serve Mr. Tima's <br />property and Thomas Judd's .property. <br />Timmons agreed that 40 feet of right -of -way would be sufficient. <br />Mr. Thomas Judd stated that he was willing to dedicate the additional <br />7 feet of right -of -way. Judd stated that the people owning Lot 1 <br />may be oposed to the improvement of Jackson Street. Judd also <br />pointed out that if he dedicated 17 feet of right -of -way as <br />recommended by the Planner it would eat up his square footage, <br />and he would not have a buildable lot. <br />Tima stated that if Judd dedicated the 7 feet of right -of -way and <br />this resulted in his not having enough square footage for a buildable <br />lot, he was willing to adjust the property line to add the necessary <br />square footage to the Judd property. <br />Mrs. Timmons recommended approval of the Louis Tima property <br />division with the requirement of dedication of 7 feet of right -of -way <br />for Jackson Street between Bluwood and Australian for a total of <br />40 feet of street right -of -way. <br />Motion seconded by Mr. DeLonais. <br />Motion carried 6 - 0. <br />Page -3- <br />
