MINUTES <br />Planning Commission <br />June 12, 1996 <br />Thoe The Planner reported that he has not seen the plans for the <br />Side Yard garage, however, he has discussed the proposal with the City <br />Setback Clerk and has determined that there is no hardshin present on <br />Variance which to grant a variance. <br />(Cont.) <br />Fred Rusch <br />House <br />Relocation <br />Mrs. Timmons pointed out that a property owner on Carla Lane has <br />been denied a variance in order to construct a garage because there <br />is no hardship present. <br />Timmons felt that based on the information that the Commission has, <br />the request should be denied. <br />Mr. Perlinger recommended denial of the Thoe side yard setback <br />variance request to construct a garage on his property three feet <br />from the property line due to the fact that there is no hardship <br />present to grant a variance. <br />!lotion seconded by Mr. Herkenhoff. <br />Motion carried 7 - 0. <br />Mr. Fred Rusch appeared before the Commission requesting approval <br />to relocate a house on his property on Lakeshore Avenue directly <br />across from the Tom Thumb store. Rusch presented pictures of the <br />house and reported that it consists of 835 square feet. Fred <br />Rusch reported that an addition is planned for the house which <br />will increase the square footage and exceed the City's minimum <br />square footage requirement. <br />Mrs. Timmons asked if a garage would be built. <br />Rusch replied that no garage is planned at this time. <br />Timmons questioned whether City Code required a garage. <br />The Planner replied that the Code does not require a garage, just <br />that the house be located so that a garage can be built in the <br />future without need for a variance. <br />Mrs. LaSore, 2729 Lakeshore, reported that in the past Mr.Susch has <br />requested approval for a duplex on this property and when this <br />request was denied he informed the neighbors that he would move <br />a piece of junk onto that property. LaBore also questioned Mr. <br />Rusch's claim that his lot was 80 feet wide and indicated that <br />it was her feeling that the lot was 63 feet wide. <br />Mr. Rusch stated that he has a survey of the property. <br />Page -7- <br />1 <br />
