MINUTES
Planning Commission
August 14, 1986
Text Frattalone stated that he has a building there and he has to find
Amendment a use for it. Frattalone pointed out that when the building
(Cont.) burnt down five years ago the City allowed him to rebuild it.
Davison asked what the specific problems were in allowing the lawn
maintenance businesses to occupy the building. Davison asked
if there were problems with the quality of the building.
The Planner replied that regardless of the problems on site,
lawn maintenance was not a permitted use in 6 -3. 8 -3 is a retail
district and there is usually retail sales and service. A retail
business is usually cleaner and there is no outdoor storage.
Timmons felt it was unrealistic to assume the property would be
used for retail sales and pointed out the location of the property
and difficult access to it.
Timmons stated that she did not know what alternatives there were
for using the site other than approving the conditional use permit
under the conditions outlined by the Planner.
Steve Magneson, 2593 Spruce Street, reported that he has a problem
with the noise and dust coming from Mr. Frattalone's property.
Mark Schultz, 2610 Park Street, asked the Commission to consider
that the request is not consistent with comprehensive land use
plan for the area, and the existing site is not compatible with
present and future land use of the area, and that the previous use
of the property does not indicate a willingness of the property
owner to conform to the standards of the City Ordinances.
Mr. Schultz read from several past Council meeting minutes and
letters from the City files regarding the Frattalone property and
problems that have been reported and discussed regarding this
property. Dates of the various Council meeting minutes include:
July 10, 1974, August 14, 1974, July 8, 1974 Planning Commission
meeting minutes, November 10, 1982 Council meeting, November 24,
1982 Council meeting, September 27, 1984 letter from Building
Inspector, April 29, 1985 letter from Building Inspector,
April 26, 1985 letter from City to Mr. Frattalone, June 6, 1985
letter from City to Mr. Frattalone, July 12, 1985 City Council
minutes.
Timmons pointed out that some of the problems discussed in these
minutes and correspondence were caused by businesses that are
no longer tenants of the Frattalone property. Some of these
issues are no longer relavent.
Frattalone stated that the issue of his using Park Street, which
was discussed in the meeting minutes read by Schultz, was that he
did not use the street when it was 3 -ton. However, when the
Page -3-
