MINUTES <br />Planning Commission <br />August 14, 1986 <br />Text Frattalone stated that he has a building there and he has to find <br />Amendment a use for it. Frattalone pointed out that when the building <br />(Cont.) burnt down five years ago the City allowed him to rebuild it. <br />Davison asked what the specific problems were in allowing the lawn <br />maintenance businesses to occupy the building. Davison asked <br />if there were problems with the quality of the building. <br />The Planner replied that regardless of the problems on site, <br />lawn maintenance was not a permitted use in 6 -3. 8 -3 is a retail <br />district and there is usually retail sales and service. A retail <br />business is usually cleaner and there is no outdoor storage. <br />Timmons felt it was unrealistic to assume the property would be <br />used for retail sales and pointed out the location of the property <br />and difficult access to it. <br />Timmons stated that she did not know what alternatives there were <br />for using the site other than approving the conditional use permit <br />under the conditions outlined by the Planner. <br />Steve Magneson, 2593 Spruce Street, reported that he has a problem <br />with the noise and dust coming from Mr. Frattalone's property. <br />Mark Schultz, 2610 Park Street, asked the Commission to consider <br />that the request is not consistent with comprehensive land use <br />plan for the area, and the existing site is not compatible with <br />present and future land use of the area, and that the previous use <br />of the property does not indicate a willingness of the property <br />owner to conform to the standards of the City Ordinances. <br />Mr. Schultz read from several past Council meeting minutes and <br />letters from the City files regarding the Frattalone property and <br />problems that have been reported and discussed regarding this <br />property. Dates of the various Council meeting minutes include: <br />July 10, 1974, August 14, 1974, July 8, 1974 Planning Commission <br />meeting minutes, November 10, 1982 Council meeting, November 24, <br />1982 Council meeting, September 27, 1984 letter from Building <br />Inspector, April 29, 1985 letter from Building Inspector, <br />April 26, 1985 letter from City to Mr. Frattalone, June 6, 1985 <br />letter from City to Mr. Frattalone, July 12, 1985 City Council <br />minutes. <br />Timmons pointed out that some of the problems discussed in these <br />minutes and correspondence were caused by businesses that are <br />no longer tenants of the Frattalone property. Some of these <br />issues are no longer relavent. <br />Frattalone stated that the issue of his using Park Street, which <br />was discussed in the meeting minutes read by Schultz, was that he <br />did not use the street when it was 3 -ton.
