MINUTES <br />Planning commission <br />August 14, 1985 <br />Text road was upgraded to a 9 -ton road in 1983 he did begin using <br />Amendment the road and he paid an assessment for that road. Frattalone <br />(Cont.) also pointed out that this spring he closed off the access to <br />Park Street and has been using County Road C for access. <br />Schultz stated that he did not have a problem with Mr. Frattalone's <br />use of the street, but wanted to see 8 -3 businesses in on that <br />site. Schultz stated that when 'Mr. Frattalone's building burnt <br />down, he rebuilt the building knowing that it was non-conforming. <br />Schultz felt that the property devalued his property. <br />Mr. Frattalone pointed out that Mr. Schultz purchased his property <br />knowing what was on the Frattalone property. <br />Mrs. Timmons suggested that Mr. Schultz should have provided the <br />Commission with the correspondence that he read so that the <br />Commission could follow it better. <br />Mrs. Schultz commented that Mr. Frattalone has received preferential <br />treatment and has not been required to conform to the City's <br />ordinances. <br />Timmons stated that the Commission is well aware of the problem <br />on the site. However, the businesses referred to in the minutes <br />Mr. Schultz read are no longer occupying the property. Timmons <br />stated that the Commission is aware that Mr. Frattalone's track - <br />record has not been a good one, but the matter has to move on <br />from this point. <br />Timmons stated that one of the things that has to he decided is <br />if the text amendment is approved what types of conditions will <br />he placed on the conditional use permit. <br />Timmons felt that the continents should be directed towards the <br />proposal of the lawn maintenance businesses. Timmons stated <br />that the Commission is aware that Mr. and Mrs. Schultz do not <br />believe that tlr. Frattalone will keep his word. <br />Schultz felt that all the information he has provided has been <br />relative to the issue before the Commission tonight. Schultz <br />outlined provisions in the City Code which require that the site <br />will be compatible with the comprehensive plan. <br />Schultz also pointed out that the Frattalone property has <br />depreciated the value of his property and his property taxes <br />were lowered by Ramsey County based on the condition of the <br />Frattalone property. Schultz also reported that the house <br />next to him has been for sale a couple of times, and could <br />not be sold because of the condition of the Frattalone property. <br />Frattalone pointed out that the Schultz property was bought <br />cheaper because it was across from commercial -zoned property, <br />and that his building was there before Mr. Schultz bought the <br />property. <br />Page -4- <br />
