MINUTES <br />Planning Commission <br />November 13, 1936 <br />McCulloch <br />Conditional <br />Use Permit <br />(Cont.) <br />Adele <br />Hanson <br />Lot Split <br />And Side <br />Yard Setback <br />Variance <br />Mr. Herkenhoff recommended that the Ray McCulloch request for <br />conditional use permit be tabled pending submission of a site plan. <br />Motion seconded by Mr. DeLonais. <br />Motion denied. Herkenhoff anc' DeLonais voted in favor. Timmons, <br />Davison, Perlinger and Schweizer voted against. <br />Timmons recommended approval of the Ray McCulloch conditional use <br />permit with special consideration to be given to the number of <br />additional parking spaces required on the lower level of the <br />property and with the recommendation that the PUD Agreement he <br />amended to limit the number of clients that can be in the building <br />at any one tine. <br />Motion seconded by Mr. Perlinger. <br />Motion approved. Timmons, Davison, Perlinger and Schweizer voted <br />in favor. Herkenhoff and DeLonais voted against. <br />Ray and Adele Hanson appeared before the Commission requesting <br />approval of a lot split for property located at 3001 Vanderhie <br />Road as well as a variance for the side yard setback of the <br />existing home. <br />The Plannerreported that under the existing ordinance, the home <br />at 3001 Vanderbie is non - conforming due to inadequate sideyard <br />setback. <br />The Planner reported that the ordinance requires that when there <br />is a change on the property, non-conformances should he brought <br />into conformance. <br />The Planner, however, recolnended approval of the variance as <br />the sideyard setback 1s already exi sting and Allen Avenue has a <br />66 foot platted right- of -.,,ay while Code requires that new residential <br />streets only have 50 -foot platted right -of -ways. <br />The Planner pointed out the thoroughfare plan for the area <br />which proposes the extension of Noel Drive. The proposed lot <br />would abutt Noel Drive, however, all Code requirements would be <br />met on the new lot. <br />Timmons pointed out that when a house is built on the new lot, <br />it would be even closer to the street than the existing house <br />due to the change in street right -of -way requirements. <br />Pane -3- <br />
