N1'1UTES <br />Planning Commission <br />November 13, 1986 <br />Adele <br />Hansom <br />Lot Split <br />And Side <br />Yard Setback <br />Variance <br />(Cont.) <br />Timmons felt that it was not wise to set a precedent on a case <br />where there was no real hardship. However, Timmons pointed out <br />that if a precedent is set, another situation would have to fit <br />that precedent exactly. Timmons felt that this would be difficult <br />to do in this case. <br />The Planner pointed out that a case would have to be similarly <br />effected by a thoroughfare plan and also a residential street <br />having a 65 -foot right -of -way. <br />Timmons pointed out that given the same situation, the Commission <br />would probably act the same way. <br />Timmons also pointed out that three lots to the west of the Hansen <br />property, the right -of -way for Allen Avenue is reduced to 60 feet. <br />Mr. Davison recommended approval of the Hansen property division <br />as requested contingent upon the recommendations of the City <br />Planner contained in his memo dated November 4, 1986. <br />Motion seconded by t.ir. Herkenhoff. <br />Motion carried 5 - 0. <br />Mr. Hanson reported that he was willing to comply with the <br />recommendations of the City Planner. <br />Mrs. Timmons recommended approval of the Hanson side yard setback <br />variance as requested subject to the conditions contained in the <br />Planner's report dated November 4, 1935. <br />Motion seconded by Mr. Davison. <br />Motion carried 5 - 0. <br />Page -4- <br />
