MINUTES <br />CITY COUNCIL <br />FEBRUARY 8, 2006 <br />noted that four members of the City Council will have to vote in favor to <br />the Text Amendment in order for it Co pass. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006-2-27 -APPROVING THE TEXT <br />AMENDMENT TO THE ZONING CODE CREATING A <br />CONDITIONAL USE PERMIT TO ALLOW FOR RECREATIONAL <br />USES IN A FRONT YARD IN THE SINGLE FAMILY (R-I) ZONING <br />DISTRICT SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AND THE <br />PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Allen. <br />Ayes (1) Montour. <br />Nays (4) Allan, Keis, LaValle, Blesener. Resolution failed. <br />Blesener noted that since the Text Amendment did not pass, there <br />Conditional Use Permit for recreation use in the front yard is a mute point. <br />The City Attorney indicated that that is correct given Che Text Amendment <br />would have created the Conditional Use Permit for that use. The Text <br />Amendment failed; therefore, the CUP process was not created. <br />Blesener suggested that the Council establish a Cime frame for removal of <br />the sports court from the Galba front yard. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006-2-28 -DECLARING THAT THE SPORTS <br />COURT IN THE FRONT YARD AT 2580 EDGERTON STREET, <br />MATT AND STEPHANIE GALBA PROPERTY, MUST BE <br />REMOVED BY JUNE I, 2006 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) LaValle, Keis, Blesener, Allan. <br />Nays (1) Montour. Resolution declared adopted. <br />Blesener noted that the remaining item for consideration is the Conditional <br />Use Permit for two attached garages on the Galba property at 2580 <br />Edgerton Sheet with total garage space proposed at 1,490 square feet. <br />Blesener pointed out that Che garage space is already in existence. <br />The City Planner pointed out that the garage space meets the City's <br />requirements for two garages and is below the 1,500 square foot <br />maximum. He noted that the parcel is a large, and the 1,490 square feet of <br />garage space will not be out-of-character given the size of the property. <br />13 <br />
