MINUTES <br />CITY COUNCIL <br />MARCH 27, 2013 <br />DATED MARCH 27, 2013, AND SUBJECT TO THE PROPERTY <br />OWNER OBTAINING BUILDING PERMITS FOR SIGN <br />INSTALLATION <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />CUP & Montour opened the Public Hearing to consider the application for <br />VARIANCE — Conditional Use Permit allowing total garage space of over 1,000 <br />790 LAHORE square feet and a Variance to allow total garage space exceeding 1,500 <br />ROAD — square feet for 790 LaBore Road requested by Chris and Katya Jaede. <br />JAEDE The Planning Commission recommended approval of the Conditional Use <br />Permit, but sent the Variance request to the Council with a 3 to 3 vote. <br />The City Planner reported that the applicant is requesting total garage <br />space over 1,000 square feet and a Variance to allow garage space over the <br />1,500 square foot limitation provided by Code. The Planner noted that at <br />the Planning Commission meeting the total garage space being requested <br />was reported at 1,534 square feet. The Planner noted that in considering <br />the Variance, the Planning Commission discussed the fact that this is a <br />large piece of property consisting of four lots. The applicants reported <br />that the four lots are being combined into one parcel, and it is their <br />intention to retain the property as one large parcel. The Planner noted that <br />the size of the parcel factored into the Commission's split vote on the <br />Variance. He also noted that planning staff is recommending against the <br />Variance given the findings that must be met to grant a variance. The <br />Planner stated that in this case it is difficult to find that there are practical <br />difficulties in putting the property to a reasonable use, or that any such <br />difficulties are not created by the applicant. Additionally, the <br />requirements utilize standard of uniqueness. While the applicants suggest <br />that architecture and lots size are unique to this particular property, larger <br />single family lots are not uncommon in the City and the City has a variety <br />of architectural styles. The Planner noted that shortening the depth of the <br />garage by as little as 3 inches would leave the building in compliance with <br />the Zoning Code without a Variance. This reduction in depth would not <br />appear to affect the width as it relates to garage door requirement, and <br />would not affect the practical use of the garage. The Planner noted that at <br />just less than 27 feet in depth, it would still be larger than necessary to <br />accommodate even large residential vehicles along with storage and <br />circulation. <br />Chris Jaede, 790 LaBore Road, appeared before the Council requesting a <br />CUP to exceed 1,000 square feet of garage space and a Variance to exceed <br />3 <br />
