MINUTES <br />CITY COUNCIL <br />SEPTEMBER 27, 2006 <br />Keis noted Chat Sedaghat was given 90 days to clean up the property, and <br />iC has not been done. He is now requesting additional Cime, with no plan <br />for how he will accomplish Che clean-up and resolve the Code violations. <br />SedaghaC replied that he has a plan and needs a little bit more Cime. <br />Montour asked how much time was needed. Sedaghat pointed out that <br />winter is coming, and ideally would like an additional year. SedaghaC <br />reported thaC during Che winter he would have more time to spend cleaning <br />up the property and Che lot would be empty nexC year. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Blesener, seconded by Allan, the public hearing was <br />closed. <br />The City Administrator reported that Valor's Auto Sales and Auto Repair <br />Licenses expire as of today. Therefore, the Council should consider <br />whether or not those licenses will be renewed. <br />The City Attorney indicated Chat if the Council's action is to revoke the <br />Conditional Use Permits for Valor Enterprises, findings of fact should be <br />listed as part of the revocation action. <br />Montour asked where this action would get Che City in terms of getting the <br />property cleaned up. He noted that Valor Enterprises will be out of <br />business, but the condition of the lot will remain as is. The City <br />Administrator indicated that abatement of the nuisance will be a <br />complicated process given that there are finance companies involved as <br />well as private parties who own vehicles being stored on the lot. The City <br />AtCOrney indicated ChaC the City will have to develop the facts that this is a <br />hazardous site and then move to abate the nuisance relative to cleaning up <br />the property. <br />The City Attorney reported that apre-trial was scheduled for today on the <br />five violations that Mr. Sedaghat was cited for. Mr. SedaghaC did not <br />appear at the pre-trial and the court issued a warrant for his arrest. That <br />warrant was stayed for 24 hours so that Mr. Sedaghat could attend <br />tonighC's Council meeting and not be arrested. Mr. Sedaghat reported hat <br />he called the court and talked Co the City's prosecutor Co Cell him he could <br />noC attend today as he was meeting with the City AdrninistraCOr to try to <br />resolve the matter. Mr. Sedaghat inferred thaC he was, then, not required <br />to attend the pre-trial. The City Attorney disagreed, and indicated that <br />since Mr. Sedaghat did not have good cause for not making an appearance <br />at court, the warrant was issued. <br />12 <br />
