MINUTTrS <br />CITY COUNCIL <br />SEPTRMBIJR 27, 2006 <br />Sedaghat pointed out that he can do auto detailing on his property without <br />a license. He again asked to meet with Council Members individually. <br />SedaghaC indicated that he has been dealing with impossibilities. <br />Montour pointed out that five years ago Sedaghat agreed to the limitation <br />of 20 repairables and 30 for-sale vehicles. Since that approval, Sedaghat <br />has had easily double the number of vehicles he was allowed. Sedaghat <br />stated that this shows the Council that the numbers they approved were too <br />low. <br />Montour and Blesener agreed that there does not appear to be a way to <br />resolve this issue other than revocation. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006-9-22I -REVOKING CONDITIONAL USE <br />PERMITS FOR RETAIL AUTO SALE5 AND OUTDOOR STORAGE <br />ISSUED TO MR. FRED SEDAGHAT, DOING BUSINESS AS VALOR <br />ENTERPRISES, AT 3767-3767 SPRUCE STREET BASED ON THE <br />FOLLOWING FINDINGS OF FACT: <br />THERE HAS BEEN FAILURE TO COMPLY WITH THE <br />REQUIREMENTS OF THE CONDITIONAL USE PERMIT <br />APPROVALS BY THE DESIGNATED DEADLINES OF DECEMBER <br />31, 1999 AND JUNE 30, 2000; <br />THE PROPERTY HAS BEEN CONTINUALLY NON-COMPLIANT <br />WITH THE AGREED UPON CONDITIONS OF NO MORE THAN 20 <br />REPAIRABLE VEHICLES AND NO MORE THAN 30 FOR-SALE <br />VEHICLES; <br />THE PROPERTY HAS NON-COMPLIANT OUTDOOR STORAGE <br />OF TIRES AND VARIOUS AUTO PARTS; <br />REQUIRED PAVING OF THE PARKING AREAS HAS NOT BEEN <br />DONE AND PERIMETER CURBING HAS NOT BEEN INSTALLED; <br />THE APPROVED NUMBER OF REPAIRABLE AND FOR-SALE <br />VEHICLES HAVE NOT BEEN STORED IN THE APPROVED- <br />DESIGNATEDAREAS; <br />THE PROPERTY IS NON-COMPLIANT WITH THE PEVIOUSLY <br />APPROVED SITE PLAN <br />14 <br />
