MINUTES <br />CITY COUNCIL <br />SEPTEMBER 27, 2006 <br />CONDITIONAL The Mayor opened the Public Hearing to consider a Conditional Use <br />USE PERMIT Permit for open and outdoor storage as an accessory use and a Variance <br />& VARIANCE - allowing open and outdoor storage in the side yard as requested by Mr. <br />310 COUNTY Bob Murray for property located at 310 County Road D East. It was <br />ROAD D - noted that the City Planner and Planning Commission have recommended <br />BOB MURRAY approval of the CUP and Text Amendment. <br />Mr. Ward Sensing, Sensing Architects, appeared before the Council <br />representing Mr. Bob Murray. Sensing reviewed a revised site plan for the <br />outdoor storage area which reduces the outdoor storage to ] 0%n of the size <br />of the building. <br />Blesener noted that a hardship must be present in order to warrant granting <br />of a Variance so that outdoor storage could be in the side yard of the <br />property. Blesener noted that there is a very limited rear yard behind the <br />building. Given the configuration of the loC, Blesener agreed that this was <br />hardship enough to warrant the Variance. Blesener asked if Sessing was <br />agreeable to limiting the outdoor storage area to ]0% Che size of the <br />building. <br />Allan noted that she visited the site and noticed some sort of chemical <br />storage in the outdoor storage area. <br />Kyle Gillesby, Rink Tech, indicated that they are an ice rink conshvction <br />and service company. He indicated that they douse ethylene glycol (anti- <br />freeze) in their business, but noted that it is not stored in the outdoor <br />storage yard. There was some discussion about whether or not there were <br />chemicals being stored in the outdoor storage area, and Gillesby assured <br />that Council that there was not. <br />Sessing indicated that in his review of the Code, it appeared that the <br />outdoor storage of trailers was exempC from the 10% limitation. It was <br />noted that the Code exempts semi-trailers, not the smaller trailers Chat <br />Rink Tech has. Therefore, they would be calculated into the outdoor <br />storage limitation of 10% of the building size. <br />Sessing indicated Chat they would abide with the 10% outdoor sYOrage <br />limitation. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Blesener, seconded by Allan, the public hearing was <br />closed. <br />
