The site plan submitted has shown the structure located at <br />approximately 33 feet from the front property line. The Zoning Ordinance requires <br />a 40 foot front yard setback in the 1 -1 District. In discussing this with the <br />applicant, he indicated that it would not be a problem to move the building back <br />to 40 feet in compliance with the ordinance. <br />The Zoning Ordinance requires side yard setbacks of 15 feet. The Site Plan shows <br />16 feet on the south side of the building, but only six feet on the north side - a <br />situation which will require a variance. In addition, the six feet on the north <br />side will be reduced somewhat if the building is moved back from the street to <br />comply with the front yard requirements. While we typically strongly encourage <br />discretion in approving variances, it is felt that in this case a variance may be <br />warranted. First, the property configuration is somewhat difficult to deal with. <br />While the lot has adequate area, it is long and narrow and tapers at the rear. <br />Further, it is suggested that the intent of yard setback provisions be considered. <br />Setbacks are intended to ensure proper structure organization, prevent over- <br />crowding of structures and provide open space. Since the property to the north <br />is railroad right -of -way and there are no apparent plans to abandon this line, it <br />appears that the potential for another structure to be built directly north is not <br />likely to occur for quite some time. If the side yard variance is approved, the <br />Site Plan should be revised in order that the Building Official has a reference <br />for checking the location of the building on the site. <br />Parking. The existing Zoning Ordinance does not allow parking in front yard <br />areas other than neighborhood business districts. However, this issue has been <br />previously discussed with the City and has been changed in the Zoning Ordinance <br />revision presently under consideration by the City. <br />Also, while the number of spaces shown on the Site Plan is only three, there appears <br />to be adequate room for parking in the rear. Further, Mr. DeBace is pursuing <br />getting permission from NSP to park on their easement. <br />Mr. DeBace has indicated that the front parking /loading area and the driveway <br />back to the end of the building will be blacktopped. <br />Access to the site is provided by a single driveway off of Country Drive. The <br />driveway is located as far from the railroad intersection as possible and is con- <br />sidered acceptable. <br />9 <br />
