MINUTES <br />CITY COUNCIL <br />MAY 24, 2006 <br />RESOLUTION NO.2006-5-I77 -APPROVING THE CONDITIONAL <br />USE PERMIT FOR TWO GARAGES (ONE ATTACHED AND ONE <br />DETACHED) AS WELL AS TOTAL GARAGE SPACE OF <br />APPROXIMATELY I,3I0 SQUARE FEET AS REQUESTED BY <br />ANTHONY ZURN FOR 2944 GREENBRIER STREET SUBJECT TO <br />COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY <br />PLANNER AS OUTLINED IN HIS MAY 4, 2006 REPORT, SUBJECT <br />TO THERE BEING NO BUSINESS USE OF THESE GARAGES, <br />AND SUBJECT TO THE GARAGE DOORS FOR THE NEW <br />GARAGE FACING INTO THE BACK YARD AREA OF 2944 <br />GREENBRIER STREET <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CUP & Blesener opened the Public Hearing to consider a request for a <br />VARIANCE- CondiCional Use Permit to allow Che expansion of anon-conforming <br />2367 structure as well as a Variance to allow a front yard setback of less than <br />McMENEMY thirty feet as requested by Tonia and Brian Bevers for 2367 McMenemy <br />STREET - Street. The City Planner and the Planning Commission have <br />BEVERS recommended approval of the CUP and Variance based on the hardships <br /> that exist unique to this property as outlined in the City Planner's report <br /> dated May 4, 2006. <br />Brian Bevers appeared before the Council and reported that they would <br />like to add a bedroom, bath, and dining room onto their house. They <br />would possibly add a basement under the addition depending on the cosC <br />Co do so. Bevers noted the restrictions unique Co this property that hamper <br />their ability to add onto the house while conforming to the required 30- <br />foot front yard setback. <br />Blesener outlined Che hardships that the City Planner stated in his report in <br />support of the Bevers' variance request. These are as follows: <br />o To the west is a steep slope into a wetland thaC restricts Che <br />ability to add to that direction. <br />o To the south is the Williams gas pipeline easement -within <br />one foot of the house -that restricts expansion in Chat <br />direction. <br />o To the east is McMenemy Street. <br />o The McMenemy Street right-of-way is 66 feet in width, <br />wider than Che City's standard residential street of 50 feeC. <br />
