PIANNED UNIT DEVELOPMENT <br />AGREEMENT <br />Planned Unit Development Agreement made this day of 1980, <br />between THE CITY OF LITTLE CANADA, hereinafter referred to as "City" and CAMERON <br />DEVELOPMENT CO., a Minnesota corporation, hereinafter referred to as "Applicant ": <br />WITNESSET11: <br />WHEREAS, the Applicant has requested building permits from the City for <br />the construction of a Planned Unit Development on land within Little Canada and <br />legally described on Exhibit "A ", attached hereto and incorporated herein by <br />reference; and <br />WHEREAS, the City has given tentative concept approval for the Applicant's <br />preliminary site plan. <br />NOW, TIIEREFORE, In consideration of the mutual covenants and agreements <br />herein, the parties hereto agree as follows: <br />GENERAL <br />1. All construction shall he in compliance with all applicable codes and <br />ordinances of the City except as modified herein. <br />2. Approval 1s hereby granted for a Concept and Development Plan. <br />Grading and building permits shall not be issued until: <br />A. Satisfactory arrangements have been made for utility service. <br />Questions relating to ecology, preservation of low -wet area and <br />the like have been resolved through discussion with the State <br />Department of Natural Resources and other°, and obtaining <br />necessary permit°. <br />C. Drainage and pending on adjacent land is properly coordinated <br />with the PUD development. <br />A grading plan has been submitted in sufficient detail to provide <br />an adequate basis for evaluation by the City Engineer and action <br />by the City Council. The plan must include provisions for duet <br />and erosion controls. <br />E. Final plats have been approved by the City. <br />Detailed plans have been approved by the City showing building <br />elevations, floor plane, landscaping and similar details. <br />The Appl icant may develop the PUD in stages in accordance with the general <br />plan of development attached hereto as Exhibit "B". <br />Effect of Minimum Area Requirements on Conveyed Lots or Building Sites. In <br />the event of any real property in the approved PUD permit is conveyed in <br />total or in part, the buyers thereof shall be bound by the provisions of <br />
