MINUTES <br />Planning Commission <br />Feb. 12, 1987 <br />Lakeview <br />Estates <br />(Cont.) <br />Howe replied that the homes would be set back 30 feet from the <br />property line. <br />The Planner reported that if the County ever wants to widen <br />Edgerton, it will have to purchase additional right -of -way from <br />the other property abutting the street. <br />Mrs. Timmons recommended approval of the front yard setback variance <br />for Lakeview Estates as requested by Mr. Gordy Howe. <br />Motion seconded by Mrs. Schweizer. <br />Motion carried 6 - 0. <br />Sign Mr. Roger Phillips appeared before the Commission requesting approval <br />Variance of a sign variance for his service station located on Little Canada <br />Union 76 Road. Mr. Phillips reported that the Mobil Oil Company has traded <br />Roger property and the station will become a Union 76 station. The existing <br />Phillips signage will remain as is, however, the Mobil signs will be changed to <br />Union 76 signs. Phillips indicated that if it is the City's desire <br />that the rotating sign be stopped from rotating, he is willing to do <br />this. <br />Mrs. Timmons pointed out that Mr. Phillips has been in business at <br />his location for 16 years, and due to the trade between Mobil and <br />Union 76, new signage is needed. <br />The Planner replied that he understood the situation, however, Mr. <br />Phillips is over his signage allotment, and the ordinance requires <br />in situation such as this, that signage be brought into conformance <br />with the ordinance. <br />Herkenhoff pointed out that the Planner recommended denial of the <br />request due to lack of a hardship. However, Herkenhoff felt that <br />there was a hardship present. <br />The Planner stated that a hardship cannot be economic in nature. <br />Timmons stated that she understood the reasons for the Planner's <br />recommendations, however, felt that variance requests should be <br />looked at individually. Timmons felt that the variance should be <br />granted. <br />Herkenhoff pointed out that this is not a complete turn -over of <br />a business and pointed out that Mr. Phillips has done business <br />in the City for many years. <br />Timmons pointed out that the corner is a congested one and will <br />be even more congested when work starts on the Little Canada Road <br />bridge widening project. <br />page 2 <br />
