City Council <br />larch 23, 19:33 <br />Appendi <br />Non -- Agenda <br />Item No. 1 <br />Gary Smith i <br />Matter <br />Agenda <br />Item No. 8 <br />Mr. Fahey asked when the Council will be actin; on Appendix E. The <br />Building Inspector replied that Appendix is presently in front of the <br />Attorney General and the Council will probably be considering; it <br />within the next year. <br />The Engineer reported that he has not received a signed easement from <br />either Dolores Corbo or Mr. Caplette regarding the Gary Smith matter. <br />The Engineer also reported that Mr. Smith would like to put in a typical <br />sewer connection to his proposed home. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 83 -3 -126 — BRINGING FROM TABLE <br />THE GARY SMITH /CAPLETTE MATTER <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />Ayes (5) Scalze, Hanson, Forsberg, Fahey, Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 9, Page 140. <br />Mr. Smith requested that the City grant his building permit contingent <br />upon his getting a signed easement. Mr. Smith reported that his <br />house will meet City Code and also stated that he plans to run a <br />4 —inch sewer. line. <br />Mrs. Nardini stated that Mr. Caplette still has legal control of the <br />property. <br />Mr. Smith commented that he would like to put in the 4 —inch line and <br />upon the future development of the Caplette property, he would like <br />his property exempt from any sewer assessment. <br />Mrs. Nardini stated that she thought the Council previously discussed <br />that Mr. Smith would have to he in favor of any future assessment. <br />Mr. Fahey stated that Mr. Smith would have to pay his fair share. <br />Mr. Forsberg stated that the next two lots will be developed. Forsberg <br />pointed out that the City must plan for the future. Forsberg pointed <br />out that the City is already allowing inadequate road access to the <br />property. <br />Mr. Fahey stated that he thought the sewer problem was all worked out <br />and the City wanted a six inch line installed and that Mr. Smith would <br />participate in any future road assessment. Mr. Smith stated that he <br />does not object to the street assessment, however, he would not want <br />to be assessed for sewer. Page 111 <br />
