The Engineer <br />replied that this would be put in at the ti.rne the other property <br />developed. <br />Mr. Licht stated that had Mr. Smith had a title opinion done he would <br />have found that no building permit could be issued for the property. <br />Licht pointed out that problems arise when things are rammed through. <br />Licht felt the City would pay for this in the future. <br />Mr. Forsberg stated that once the line is turned over to the City, <br />Mr. Smith's obligation would stop at the property line. Forsberg <br />stated that if the street were improved, he would be in favor of <br />the building permit. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 83 -3 -127 — APPROVING THE ISSUANCE <br />OF A BUILDING PERMIT TO GARY SMITH SUBJECT TO <br />THE FOLLOWING CONDITIONS: THAT MR. SMITH OBTAIN <br />AN EASEMENT SATISFACTORY TO THE CITY AND APPROVED <br />BY THE CITY ATTORNEY FOR THE EAST 30 FEET OF THE <br />WEST 258.5 FEET OF THAT PART OF LOT 6, NORDSTROM'S <br />TWIN LAKE ADDITION, RAMSEY COUNTY, MINNESOTA <br />LYING NORTH OF THE SOUTH 32.71 OF SAID LOT 6 <br />IN A FORMAT FOR FILING AND WITH PROOF OF COMPETENCE <br />OF THE GRANTOR AS REQUIRED BY THE CITY ATTORNEY <br />AND A CONFIRMATION OF TITLE OF THE GRANTOR; <br />SECONDLY, THAT MR. SMITH BE ALLOWED TO INSTALL A <br />4 —INCH SEWER LINE IN ACCORDANCE WITH CITY CODE AND <br />CITY ENGINEER'S SPECIFICATIONS WHICH WILL ALLOW FOR <br />FUTURE EXPANSION OF THE SYSTEM FOR FUTURE DEVELOPMENT <br />OF THE AREA AND THE COST OF THE LINE IS TO BE BORNE <br />BY MR. SMITH AND THEN TO BE TURNED OVER TO THE CITY; <br />AND THIRDLY, THAT MR. SMITH ENTER INTO A DEVELOPER'S <br />AGREEMENT WITH THE CITY WITH REGARD TO THE ROAD <br />EASEMENT THAT IN THE EVENT THE ROAD IS IMPROVED FOR <br />EXTENSION INTO THE AREA THAT MR. SMITH WOULD AGREE <br />TO PAY HIS PRO RATA SHARE OF ANY ASSESSMENTS AND WOULD <br />BE DEEMED IN FAVOR OF THE IMPROVEMENT <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />Ayes (4) Fahey, Nardini, Scalze, Hanson. <br />Nayes (1) Forsberg. <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 9, Page 141. <br />Page 113 <br />
