The Attorney felt that this <br />was the case. The Attorney stated that the letter of credit says <br />nothing about the temporary structure. <br />Scalze pointed out that the Planner has indicated that it is a <br />dangerous situation at the A & W with the present curb cuts. yr. <br />Fahey commented that the State should have done something about the <br />situation. <br />Mr. Locke pointed out that the structure is temporary and commented <br />that Mr. Bode could sell this to someone else. Mr. Locke stated <br />that the structure may not be safe. <br />Mr. Licht commenter) that the fact that the structure is temporary <br />could be filed with the title of the property. <br />Mr. Fahey suggested that the Council invite Mr. Bode in and talk to <br />him about his intentions with regard to the structure. <br />Mrs. Scalze pointed out that the previous Council resolution says that <br />Mr. Bode must come hack with a temporary structure. <br />Mr. Forsberg pointed out in the previous Council minutes that the <br />minutes tie the letter of credit in with the temporary structure. <br />The Attorney suggested that the City notify yr. Bode that the letter <br />of credit will be expiring and the City wants the temporary structure <br />removed. <br />Mr. Forsberg suggested that the Building Inspector not go out until <br />Mr. Bode appears before the Council. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 83 -3 -134 — REQUESTING THAT THE CITY CLERK <br />INVITE MR. BODE TO APPEAR BEFORE THE COUNCIL <br />TO DISCUSS HOW HE WILL BRING HIS NON— CONFOPMING <br />TEMPORARY STRUCTURE INTO CONFOR'.NANCE WITH CITY <br />CODs <br />The foregoing resolution was duly seconded by Mrs. N'ardini. <br />Ayes (5) Fahey, Nardini, Scalze, Forsberg, Ranson. <br />Hayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 9, Page 148. <br />The Planner reported that he met with Mrs. Corbo on the matter of the <br />Caolette horse being used as a multiple. yr. Licht reported that they <br />will be reviewing NSP records to determine when this began. <br />Page 115 <br />
