MINUTES <br />Planning Commission <br />Dec. 10, 1987 <br />Bank Shot <br />Billiards <br />(Cont.) <br />Davison asked the hours of operation permitted under the ordinance. <br />The Planner replied that the ordinance stated that the hours of <br />operation are subject to City Council control. The Commission can <br />make a recommendation to the Council on hours of operation. <br />Schifsky reported that they are requesting that during weekdays they <br />be allowed to remain open from 11 A.M. until 2 A.M. and from 10 A.M. <br />until 4 A. M. on the weekends. <br />Costa asked why a 4 A.M. closing time is proposed. <br />Schifsky reported that they have studied other centers, some of which <br />remain open until 4 A.M. and others who are in the process of requesting <br />this. There is a demand for recreational activities during those <br />hours. <br />Costa felt there would be no problems at the billiard center as long <br />as there was no liquor involved. <br />Schifsky again pointed out that the center will be well lit and there <br />will be a large window at the front of the center. Schifsky reported <br />that he would be managing the center and he and the owners do not want <br />to be involved in a billiard center where there are problems. <br />Schifsky reported that he would like a ceiling of eight amusement <br />devices and pointed out that the Planner is recommending five. <br />DeLonais expressed concern about the bank at the back of the building. <br />The Planner replied that he has discussed this with the Building <br />Inspector who was going to look into the Codes. The Planner reported <br />that there is also some concern with the drainage of the site. <br />Davison asked what recourse the City has if it approves the billiard <br />center and there are problems down the line at the center. <br />The Planner noted that the billiard center will have a business <br />license which is issued annually. If there is a problem at the <br />center, the City also has the right to enforce its nuisance ordinance. <br />The hours of operation at the center are subject to review and change <br />by the City Council. If the terms of the conditional use permit are <br />violated, the City could revoke the permit. <br />Davison felt the City will get a lot of questions regarding the <br />center and felt that all the issues needed to be addressed. <br />Costa asked if the center anticipated problems with the bars in <br />the City closing and patrons from the bars coming over to the billiard <br />center. <br />Page 6 <br />
