MINUTI/S <br />CITY COUNCIL <br />JULY 17, 2006 <br />MOIlCOUC pointed out the outdoor storage discussion and suggested ChaC <br />eliminating metal buildings may prohibit property owners from adding on <br />to Their buildings to enclose some of this storage. Keis suggested Chat <br />there were few property owners that would add on to their buildings to <br />enclose outdoor storage. He suggested that perhaps metal should be <br />eliminated from an acceptable building material for principal buildings, <br />but could be used for an accessory building. <br />The City Planner noted that if metal is prohibited, the existing metal <br />buildings would be grandfathered in. Under the City's Code, non- <br />conforming buildings could be expanded by 25%. The City Clerk pointed <br />out recent changes Co State Law relative to non-conforming buildings and <br />uses. While the City can restrict expansions, property owners are allowed <br />to improve, replace, or modify existing non-conforming buildings. Any <br />condition that requires anon-conformity to eventually go away triggers <br />eminent domain to come into play. <br />The City Administrator suggested adding an incentive Co the Code ChaC <br />would result in less outdoor storage and/or beCCer building construction. <br />It was noted that if Rossow redevelops his large parcel, he use metal. IC <br />was noted that Rossow has indicated Chat he would like to eventually <br />redevelop this large parcel with two buildings since he has a pipeline <br />running through the parcel that he would have to work around. <br />Keis stated that the City could grant a variance to allow the two buildings <br />on the parcel, but felt any redevelopment of the site should be with <br />upgraded materials. <br />Duray pointed out that an expansion of anon-conforming building would <br />allow the expansion to be metal as well. The City Planner suggested that <br />the expansion could be up to 25% of the building size in metal. Any <br />expansion that is 26% Co 50% of the original building size would have to <br />be upgraded materials. If the expansion is over 51%, the entire building <br />would have to be broughC into conformance. <br />The City Planner indicated that he would work on this issue of upgrading <br />building materials and eliminating metal in I-1 as well as dealing with the <br />expansion of non-conforming uses. The City Administrator indicated that <br />he would research the use of geopiers to support heavier buildings in Ryan <br />Industrial Park to determine if this is a practical requirement. <br />The City Planner also noted the proposed addition of EFIS Co acceptable <br />building materials in I-1. <br />
