MINUTES CITY COUNCIL APRIL 24, 2013 conditioned that the 33 -foot road easement was vacated, which was done at the April 10th Council meeting. The Planner reviewed the Pinetree Pond Final Plat which consists of 15 single - family lots and 4 outlots. He noted that Outlots A, B, and D will be conveyed to adjacent property owners. Outlot C will be conveyed to the City for the purpose of allowing additional land for the future subdivision of the northeast properties. The Planner indicated that staff' finds that the Final Plat is consistent with the Preliminary Plat and is recommending approval of the Final Plat subject to compliance with the conditions outlined in his April 5, 2013 report. The City Engineer reviewed his report dated April 5, 2013, noting that the recommendation for drainage and utility easement over Outlot B should be corrected to read "Outlot C ". Gordie Howe, Masterpiece Homes, appeared before the Council and reviewed the Pinetree Pond Final Plat noting that it consists of 15 single - family lots as well as four outlots. Howe reported that Outlot A would be conveyed to the McCumber's, Outlot B to the Paddock's, and Outlot D to Gail Acosta. Outlot C would be convened to the City. He also reported that the two houses at 2945 and 2959 LaBore Road would be torn down. Blesener asked about Howe's goal to have a model house in the Parade of Homes. Howe replied that he would like to have a model in the Fall Parade of Homes which is the weekend after Labor Day. Blesener asked if there was anyone from the general public present wishing to comment on this matter. Laurie Brausen reported that at the Planning Commission meeting she asked where her family was supposed to bring their concerns and was informed that it was to the City Council. Dave Brausen noted that he had a copy of a concept plan for the Masterpiece Homes development that was drafted in 2011 and stated that it is almost identical to the Pinetree Ponds Final Plat. Brausen commented that it was his belief that the 33 -foot road easement was basically vacated in 2011 and that the process used by the City to get to this point this evening has been a big joke. Brausen stated he has not seen any concern displayed for his family, and he does not believe tonight is the forum where this matter will get resolved. Brausen stated that his family would like to develop their property and it has not been possible to find any 6
