constructed and used must be approved by the City Engineer. The developer shall <br />supply the City with any data, plans, or as- builts that may be requested by the <br />City Engineer. <br />2. Adequate right -of -way for streets, pedestrian ways, utilities, ponding <br />storm water drainage, or other public purposes shall be provided as may be <br />requested by the City. <br />3. All PUD development shall be properly related to and coordinated with <br />development plans for adjacent and nearby areas. <br />4. The City reserves the right to regulate and control vehicular and <br />pedestrian circulation on both public and private land within the PUD area. <br />C. Subdivision Component <br />Requirements: <br />1. Although Owner does not contemplate subdivision of the subject area at <br />this time, no part of the area shall be sold or otherwise transferred from present <br />ownership except under terms of a Council approved subdivision in accordance with <br />City's Subdivision Ordinance. <br />2. Any and all subsequent development shall be considered as part of the <br />total PUD and all provisions of this agreement shall apply following said <br />subdivision and sale of individual lots. The City shall require proof that all <br />subsequent owners are aware of said PUD conditions and provisions. <br />3. Being part of a total PUD, normal lot size, setback, and other <br />requirements may or may not be required; variations from strict code requirements <br />shall be so noted and recorded with property deeds along with all other PUD <br />conditions and requirements with specific reference made to note that <br />nonconforming conditions are not being created but that public approval of <br />detailed development plans constitutes an automotic approval of any variances that <br />may be involved. <br />4. Final plats will not be approved by the City until a development <br />agreement is entered into between the applicant and the City. <br />D. Landscaping - Buffer Zone <br />The 100 foot wide buffer zone as it appears on the Owner's Site Plan <br />(Exhibit "B "), shall be maintained by Owner as follows: <br />1. No alteration of the buffer zone shall be allowed without specific <br />City Council approval. <br />2. Owner shall maintain said buffer zone in its natural state. <br />3.
