RUTH STREET PLANNED UNIT DEVELOPMENT AGREEMENT <br />AND CONDITIONAL USE PERMIT <br />PLANNED UNIT DEVELOPMENT AGREEMENT made this day of , 1981, <br />between the City of Little Canada, a Municipal Corporation ( "The City "), and <br />, ( "The Developer "). <br />Owner: E. Hughes Construction, Inc. <br />Mni1LuLAddresn: 1/2 Battle Creek Road, St. Paul, Minn. 55119 <br />P.crmitted Uses: The Planned Unit Development °hall consist of the <br />following permitted uses: <br />Parcel I Two Family Dwellings <br />Parcel II Two Family Dwellings <br />Parcel III One Four Family Dwelling <br />Parcel IV One Four Family Dwelling <br />Parcel V One Four Family Dwelling <br />Legal Description: See Exhibit "A" attached. <br />1. Planned Unit Development Approvnl. The City hereby grants a <br />Conditional Use Permit for a Planned Unit Development in the R -2 Zoning District. <br />P.U.D. approval is based upon the site plan attached hereto as Exhibit "B ", all <br />of the provisions contained herein, and is limited to the permitted uses stated <br />above, plus the accessory uses shown:on Exhibit "8 ". <br />2. Condition of the Final Stage Approval. Prior to approval of the <br />F.U.D. Final Stage the Developer moat provide a letter of credit ( "Security ") <br />guaranteeing performance of the terms of this development contract. The letter of <br />credit shall be with a bank acceptable to the City. <br />3. Compliance with Laws and Regulations. The Developer represents to the <br />City that the proposed development complies with all City, County, Metropolitan, <br />Stnte and Federal laws and regulations, including but not limited to: subdivision <br />ordinances, zoning ordinances, and environmental regulations. If the City <br />determines that the site and site design does not fully comply, the City may, at <br />its option, refuse to allow any construction or development work on the site until <br />the Developer does comply. Upon the City's demand the Developer shall cease work <br />until there 1s compliance. <br />4. Grading Plan. The Developer shall submit n grading and drainage plan <br />16 <br />
