9. Clean -Up. The Developer shall, upon completion of the construction <br />work, promptly clear any soil, earth or debris resulting from said construction. <br />10. Park Dedication. In fulfillment of its park dedication requirement <br />for the site, the Developer shall ,sake a cash contribution to the City in the <br />amount of $ prior to issuance of building permits. The park dedication <br />fee may, at the option of the City Council, be paid in installments at the time <br />each building permit is issued. <br />11. Building Plans. The Developer shall provide construction plans for <br />each of the buildings to be constructed on the site for review by the City <br />Building Official. During the construction, the Building Official shall conduct <br />on -site inspection to ensure that development meets all applicable City and State <br />building cnden. <br />12. Utility Plans. Developer shall provide a final general site plan <br />showing the location of all utility extensions to the building for review and <br />approval by the City Engineer. <br />13. Res_ponsibillty of Costs. The Developer shall pay all costs incurred <br />by it or the City In conjunction with the development of the site. <br />A. The City's out -of- pocket expenses, previously or subsequently incurred, • <br />including but not limited to, legal, planning, engineering and inspection expenses <br />incurred in connection with approval and acceptance of the site, the preparation <br />of this development agreement and all reasonable and necessary costs and expenses <br />incurred by the City in monitoring and inspecting development of the site, for <br />which the City shall, at request of Developer, provide documentation in <br />substantiation thereof, shall all be billed to Developer. <br />B. The Developer shall pay in full all costs which are nonassessable, <br />submitted to it by the City within thirty (30) days after receipt of said hills <br />and prior to issuance of any occupancy permits. If the bills are not paid on <br />time, the City may halt all site development work until the bills are paid in <br />full. <br />14. Miscellaneous. <br />A. This agreement shall be binding upon the parties, their heirs, <br />successors or assigns, as the case may be. <br />B. Breach of any terms of this agreement by the Developer shall be grounds <br />18 <br />
