seminated by a public library shall be administered in accordance with the provisions of M.S. 15.1611 to 15.17. That portion of records maintained by a public library which links a library patron's name with materials requested or borrowed by the pa- tron who has requested information or materials is classified as PRIVATE, purusant to M.S. 15.162, Subd. 5a, and shall not be disclosed except pur- suant to a valid court order. 11. Investigative detention data (confidential with exceptions) (M.S. 15.1679) Investigative detention data is CONFIDENTIAL and shall not be disclosed except: (a) pursuant to M.S. 15.163 or any other statute; (b) pursuant to a valid court order; or (c) to a party named in a civil or criminal proceeding, whether adminis- trative or judicial, to the extent required by the relevant rules of civil or criminal procedure. 12. Other. (List any additional types of infor- mation the city has which have been classified by federal law, state statute or temporary classi- fication by the Department of Administration.) Note to Responsible Authority. All government data collected, created, received, maintained or disseminated by the city is public unless classified by statute, federal law, or temporary classification pursuant to M.S. 15.1642. Before any additional information may be listed above and classified as private, confidential, or not public, the Responsible Authority, must find a statute,or federal law, which classifies that data, or he /she must apply for a temporary classifi- cation to the Commissioner of Administration on forms provided by the Commissioner - a sample form is available from the League office. Neither the city council nor a Responsible Authority may classify any data. Private, con- fidential, and non - public data may be classified only by statute, federal law, or temporary classi- fication through the application procedure. The Responsible Authority must update this docu- ment annually and make any changes necess- ary to maintain the accuracy of the document. After each legislative session, the League will inform each Responsible Authority, through the city clerk, of any additions or changes made in the classification of information. RIGHTS OF DATA SUBJECTS (M.S. 15.165) The rights of individuals on whom the data is stored or to be stored by this city are as set forth here. 1. An individual asked to supply private or confidential data concerning himself has the right to be informed of: (a) the purpose and intended use of the requested data within this city; (b) whether he may refuse or is legally required to supply the requested data; (c) any known conse- quence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other persons or entities authorized by state or federal law to receive the data. 2. Upon request to the Responsible Authority or a designee, an individual shall be informed: (a) whether he is the subject of stored data on in- dividuals; (b) whether it is classified as public, private, or confidential. 3. Upon his further request, an individual who is the subject of stored private data on indi- viduals shall be shown the data without any charge - 18 -
