MINUTES
CITY COUNCIL
JUNE 28, 2006
use. Blesener pointed out Council Member Allan's concerns about the
level of cc's with her position ChaC the limitation should be at 250 cc's.
Schiltz reported that the vehicles they sell at this time would not exceed
250 cc's, but anticipated that within the next couple of years the
manufacturer may increase to the level of 450 or 600 cc's. Schi]tz
indicated that a minimum of 250 cc's is needed in order to operate safely
on the highway.
LaValle questioned whether the City wanted to have more stringent
regulations than the State has on these vehicles.
Blesener asked All American what their position was on the restriction
that there is no servicing of vehicles at this location. Schiltz responded
that the restriction works well for them as Chey would prefer to have the
vehicles repaired at an outside service center.
Blesener asked about the tesC driving restriction. Schiltz indicated That his
insurance coverage requires anyone who test drives one of the vehicles
have a motorcycle license. Schiltz anticipated thaC anyone with a
motorcycle license will not want one of these vehicles. Therefore, the
restriction of no testing driving on the property works well.
There was no one else from the genera] public present wishing to
comment on this matter.
Upon motion by Blesener, seconded by LaValle, the public hearing was
closed.
Mr. LaValle introduced the following resolution and moved its adoption:
RESOLUTION NO. 2006-6-I50 -APPROVING THE PLANNED
UNIT DEVELOPMENT PERMIT ALLOWING INDOOR SALES AND
DISPLAY OF SMALL MOTORCYCLES, ATV'S, AND SCOOTERS AS
WELL AS A CONDITIONAL USE PERMIT ALLOWING A RETAIL
MOTOR VEHICLE SALES LICENSE (INDOOR ONLY) FOR ALL
AMERICAN RECREATION AT 2940 RICE STREET SUBJECT TO
COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY
PLANNER AS OUTLINED IN HIS JUNE 5, 2006 REPORT,
SUBJECT TO THE RECOMMENDATIONS OF THE PLANNING
COMMISSION THAT THERE BE NO SERVICE CENTER FOR
THESE VEHICLES AT THIS LOCATION, THERE IS NO TEST
DRIVING OF THESE VEHICLES AT THIS LOCATION, AND THE
SIZE OF THE VEHICLES IS LIMITED TO 500 CC'S, BUT
I1
