MINUTES <br />CITY COUNCIL <br />JUNE 28, 2006 <br />Blesener reviewed the history of compliance check results which began in <br />1993. He indicated that it is very disappointing that there were four <br />failures in December, and that all Chree of Che cities Off-Sale liquor stores <br />failed. Blesener also noted thaC the City has historically imposed an <br />administrative fine, but then stayed the fine provided there was not an <br />additional violation for a period of one year. He also suggested that the <br />Sheriff's Department be contacted and requested to make more than two <br />alcohol compliance checks each year. <br />The manager of Saxon Lanes reported that the clerk that committed the <br />violation was immediately terminated. He indicated that the ownership of <br />Saxon Lanes has zero tolerance for these violations. <br />Blesener noted the letter received from the owner of MGM Liquor <br />explaining what happened as well as the procedures that were <br />implemented to ensure that another violation does not occur. Mike <br />Helling, MGM, reported that they card all customers that appear to be <br />aged 40 or younger. He also reported that all his clerks are required to go <br />through training. Helling reported that he has implemented a bonus <br />system for the clerks, rewarding them for passing compliance checks. <br />Helling requested thaC the Sheriff's Department come back into the store <br />to inform the clerk when a compliance check is passed similar to how they <br />handle Yobacco compliance checks. The City Administrator indicated that <br />he will discuss this procedure with the Sheriff's Department. <br />Chou Vang, Tierney's Liquors, was not sure why the violation occurred, <br />indicating that the employee who sold to an underaged individual was a <br />good employee. Vang noted that he also owns a liquor store in Roseville <br />and has certificates from the Roseville Police Department commending <br />him for the good job he does. Vang reported that he recently purchased an <br />ID reader to assist clerks in verifying ages. <br />The Council discussed the appropriate fine for these violations, expressing <br />deep concern with the violations and the need Co provide the appropriate <br />encouragement so that they do not occur again. Although there are been <br />other violations at some of these specific businesses, the City Clerk noted <br />ChaC these are first-time violations for each of the current business owners. <br />IC was also noted that while the Council has stayed past administrative <br />fines, the clerks who committed the violations have always been <br />prosecuted criminally. The criminal prosecution typically includes a <br />referral to ProjecC Remand and community service. If the Project Remand <br />program is completed and there are no further violations, there is no <br />criminal charge placed on the clerk's record. <br />18 <br />
