MINUTES <br />CITY COUNCIL <br />JUNE 28, 2006 <br />LaValle suggested that if second violations occur, the Council might <br />consider a 60 day suspension of the liquor license. Blesener again <br />suggested that the Sheriffs Department be asked to conduct more than <br />two compliance checks each year. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006-6-I52 - ISSUING AN ADMINISTRATIVE <br />PENALTY OF $500 TO SAXON LANES, MGM LIQUORS, MOON <br />BAY LIQUORS, AND TIERNEY'S LIQUORS FOR ALCOHOL <br />VIOLATIONS WHICH OCCURRED IN DECEMBER OF 2005, AND <br />STAYING THAT FINE PROVIDED THAT THERE ARE NO <br />SIMILAR VIOLATIONS FOR A PERIOD OF ONE YEAR <br />COMMENCING JUNE 28, 2006 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) <br />Nays (0). Resolution declared adopted. <br />ILLEGAL The City Clerk reported that the Sheriff's Department contacted tobacco <br />TOBACCO compliance checks on June 21, 2006, and illegal sales occurred at three <br />SALES businesses in the City. Administrative fines, as set forth in the City's <br />ordinance, have been implemented. The owner of Tierney's Liquor has <br />requested an opportunity Co address the Council on this issue. <br />Chou Vang reported that he is transferring Tierney's Liquor Co his cousin <br />effective July 1, 2006, and he is currently training the new owners. The <br />wife of the new owner was busy with customers and miscalculated the age <br />of the individual purchasing cigarettes. Vang reported Chat he has now <br />purchased an ID reader for verification of age. The cost of that reader is <br />$400. <br />The City Administrator reported that the City has imposed tobacco fines <br />for all previous violations. The City Attorney indicated that although the <br />fine schedule is laid out in the City's Code, the City Council has <br />discretion. <br />Blesener indicated Chat he was not willing to rescind the fine, and pointed <br />out the alcohol violation at Tierney's Liquors which was just discussed. <br />Mr. Blesener introduced the following resolution and moved ifs adoption: <br />19 <br />
