MINUTES <br />PLANNING COMMISSION <br />September 2, 1982 <br />Sylvan <br />Estates <br />(Cont.) <br />Flood Plain <br />Ordnance <br />Ms. Timmons commented that the determination of cash or land would be <br />up to the Parks Commission. <br />Mr. Costa asked if the Parks Commission had the right to deny the <br />Sylvan Estates development. The Planner replied that the Council <br />would be the one to make that decision. <br />Mr. Costa asked how the park charge is determined. The Planner <br />explained that it is based on the fair market value and in this <br />case would probably be 5% of that figure. <br />Ms. Timmons asked if Mr. Cecka planned single family residences for <br />the development. Mr. Cecka replied that he did and would be similar <br />to the development on Payne Avenue. <br />Mr. Cecka indicated that he was open to any suggestions for the names <br />of the roads. <br />Ms. Timmons moved that the preliminary plat for the Sylvan Estates <br />be approved subject to the eastern street being renamed and the plat <br />being reviewed by the Ramsey. County Metro Watershed. <br />Mr. DeLonais seconded the motion. <br />Motion carried 6 - 0. <br />Mr. Nielson indicated that the Commission members received a copy of <br />a proposed Flood Plain ordinance. Mr. Nielson indicated that it is <br />necessary for the City to adopt a flood plain ordinance in order to <br />maintain eligibility in the Federal Flood Plain Insurance Program. <br />The City does not have to adopt the ordinance. However, by not doing <br />so it precludes any resident of Little Canada from purchasing flood <br />plain insurance from that program. <br />Mr. Nielson indicated that the City has experienced enough problems <br />that it would be in the City's best interest to have these regulations. <br />The ordinance is a legal tool for forcing common sense on people. <br />Mr. Nielson informed the Commission that the difference between the <br />Shoreland ordinance and the flood plain ordinance is that the shoreland <br />ordinance is designed to protect the natural character of lakes and <br />rivers. The flood plain ordinance is designed to protect people and <br />property. The ordinance also keeps people from building where they <br />will be Flooded. <br />The Planner indicated that the flood plain district has been set up <br />as a zoning district and is an overlay district. That is, the <br />requirements of this district would be in addition to the requirements <br />of the primary zoning district. <br />Page -2- <br />
