-MINUTES <br />PLANNING COMMISSION <br />' September 2, 1982 <br />Flood Plain <br />Ordinance <br />(Cont.) <br />The Planner commented that the flood plain ordinance deals mainly <br />with where buildings are located and getting them above flood levels. <br />The Planner explained that the ordinance is divided into three <br />subdistricts and these are based on the degree of the problem. <br />The first district is known as the flood way district and would <br />involve the area where the actual current of water would be likely <br />to be located. This area would cover an area that would be covered <br />in a 100 year rain. The next district would be the flood fringe <br />and would be the area right outside the flood way. The next district <br />would be the general flood plain. <br />The Planner explained that in the flood way some of the uses that would <br />be allowed would be lawns, docks, parks, parking areas, argicultural <br />uses. Conditional uses that might be allowed would be structures, <br />but not those designed for human habitation and with a low flood damage <br />potential. The structures would have to placed so as not to obstruct <br />flood water. Also material and equipment would be a conditional use. <br />There would be no solid waste disposal sites allowed in this district. <br />Some of the uses in a flood fringe would include all of the uses under <br />flood way district. Residences would be allowed, but they would have <br />to be at a certain elevation above flooding level. <br />Ms. Timmons asked if existing plots without houses would be effected <br />and if the City would run into problems with these plats. Ms. Timmons <br />stated that she was thinking specifically of two lots located on <br />Schletty Drive. <br />Mr. Nielson replied that the owners of these lots would have to apply <br />for conditional use permits and show just where they are building their <br />houses in relation to the flood plain. A conditional use permit would <br />also be needed for filling. <br />Ms. Timmons questioned if this would be an ordinance the City would <br />stick by if a developer came in and was having problems with developing <br />his property under this ordinance. <br />Mr. Nielson indicated that he could not answer this question, but commented <br />that new plats would be designed around this ordinance. Ms. Timmons <br />commented that it seemed that most of the property that would be <br />involved is already platted. Mr. Nielson replied that in these <br />instances there are provisions for flood proofing the house. Mr. <br />Nielson also commented that the Watershed District would also be involved <br />within their boundaries. The DNR would also become involved. <br />Mr. Nielson commented that the proposed ordinance is based largely on <br />the State model regulations except for a change in requirements for <br />docks and making the ordinance fit the City of Little Canada. Nielson <br />stated that this ordinance would require an amendment to the City's <br />Zoning Ordinance and, therefore, needs the recommendation of the <br />Planning Commission. <br />Page -3- <br />
