MINUTES City Council I May 26, 1982 Ordinance No. 182 (Cont.) Proposed Ordinance No. 183 - Signs Agenda Item No 12 The foregoing ordinance was duly seconded by Mr. Hanson. Ayes (5) Forsberg, Hanson, Scalze, Fahey, Nardini. Nayes (0). Ordinance declared adopted. Mayor Hanson opened the public hearing on proposed Ordinance No. 183 which is the proposed amendment of the Little Canada zoning ordinance to permit freestanding signs to be located within five feet of the property line. Mr. Forsberg introduced the following resolution and moved its adoption: RESOLUTION NO. 82 -5 -297 - CLOSING THE PUBLIC HEARING ON PROPOSED ORDINANCE NO. 183 The foregoing resolution was duly seconded by Mr. Hanson. Ayes (5) Forsberg, Hanson, Scalze, Nardini, Fahey. Nayes (0). Resolution declared adopted. This resolution appears in Resolution Book No. 8, Page 249. The City Planner stated that he recommended the amendment to the zoning code to permit freestanding signs within five feet of the property line rather than 15 as currently required under the City code. Mr. Forsberg introduced the following ordinance and moved its adoption: ORDINANCE N0. 183 - AMENDING SECTION 903.110 E. 5.c (1) AND (2) ALLOWING BUSINESS SIGNS TO BE LOCATED CLOSER TO PROPERTY LINES AND PARKING AREAS The foregoing ordinance was duly seconded by Mr. Fahey. Ayes (4) Forsberg, Fahey, Hanson, Nardini. Nayes (1) Scalze. Ordinance declared adopted. Mrs. Scalze informed the Council that she opposed this ordinance as there may be a situation where a property line is located in the middle of the street. Mr. Forsberg stated that in that case the sign would have to be located five feet from the right -of -way. The Planner stated that this type of situation is covered under definition of a lot line. In this type of situation the property line would become the street or alley right -of -way. Mrs. Scalze commented that a right -of -way line could be in the middle of the street. Mrs. Scalze commented in the case of Noel Drive, the right- of -way line is in the middle of the street. )v:, O(,)
