S.P. 6214 -40 (T.H. 49 =126) Ramsey County <br />T.H. 49 (Rice St.) from Transit Ave. to 1 -694 <br />City of Little Canada <br />Agreement No. 60962 <br />RELOCATION AGREEMENT <br />THIS AGREEMENT made by and between the State of Minnesota, acting by and <br />through its Commissioner of Transportation hereinafter called the "State" and the City of <br />Little Canada hereinafter called the "Utility ", <br />WITNESSETH THAT: <br />WHEREAS, the State has prepared plans and specifications and proposes to let a <br />contract for the construction of a project on Trunk Highway 49, said project being identified <br />as S.P. 6214 -40, and the project being located on Rice Street, from Transit Avenue to I -694; <br />and <br />WHEREAS, the State has determined that it is necessary to relocate or adjust <br />sanitary sewer facility and watermain facility located in new highway right of way within <br />the limits of a city street and the Utility has requested to be reimbursed for such work <br />pursuant to the provisions of 14 MCAR s 1.5033 D. 10; and <br />WHEREAS, State law requires a written Agreement between the State and the <br />Utility setting forth their separate responsibilities. <br />NOW, THEREFORE, IT IS AGREED: <br />ARTICLE I - THE UTILITY, in consideration of the terms and conditions hereinafter set <br />forth WILL: <br />75 <br />
