Requirements: <br />1. Only those uses listed herein as permitted and /or as <br />indicated on the approved plans shall be provided for on the <br />PUD site. <br />2. Land uses permitted shall be located, constructed, <br />occupied and maintained in accordance with the provisions of <br />this Agreement and approved plans and other documents <br />attached hereto and made a part of this Agreement. <br />3. An Occupancy Permit shall be required for uses in all <br />buildings. <br />4. Appropriate plans shall be required for the uses <br />within the PUD area. <br />B. Circulation Component <br />Description: The Circulation Component attached hereto <br />as Exhibit "A" is hereby approved by the City. <br />Requirements: <br />1. The interior circulation plan plus access to and from <br />public right -of -ways shall not create congestion or danger <br />and shall be adequate for the safety of the general public. <br />The plan is subject to review and approval by the City <br />Engineer and developer shall supply the City with such data, <br />plans, or as- builts as may be reasonably required. <br />C. Subdivision Component <br />Requirements: <br />1. Although Owner does not contemplate subdivision of <br />the subject area at this time, Owner reserves the right to <br />subdivide for tax or other reasons. No part of the area <br />shall be sold or otherwise transferred from the present <br />ownership except under terms of a Council approved sub- <br />division in accordance with City's Subdivisions Ordinance. <br />2. Any and all subsequent development shall be con- <br />sidered as part of the total PUD and all provisions of this <br />Agreement shall apply following said subdivision and sale of <br />individual lots. The City shall require proof that all sub- <br />sequent owners are aware of said PUD conditions and provi- <br />sions. <br />3. Being part of a total PUD, normal lot size, setback, <br />and other requirements may or may not be required; <br />variations from strict code requirements shall be so noted <br />and recorded with property deeds along with all other PUD <br />conditions and requirements with specific reference made to <br />note that nonconforming conditions are not being created but <br />09 <br />
